What is stamp duty?

Name-only registration: Properties are registered in a wife’s, sister’s, or mother’s name to claim the reduced duty, but the actual financial contribution and ownership rest with a male buyer.
Post-registration transfer: After availing the concession, the woman is removed from ownership through gift deed or sale, undermining the intent of the policy.
Departmental scrutiny and audits:
Sub-registrar offices conduct random audits and cross-verification of transaction documents to detect such cases.
If misuse is proven, retrospective recovery of the concession amount with penalty and interest is initiated.
Legal consequences:
Recovery of the waived stamp duty with up to 10%–20% penalty and additional interest.
In serious cases, property registration may be deemed fraudulent, affecting resale or legal enforceability.
False declaration can attract prosecution under Section 64 of the Indian Stamp Act.
Note: To genuinely claim the stamp duty benefit, the woman must be an actual purchaser or financial contributor. Co-ownership should not be symbolic.
Stamp duty on agreement to sale in Chhattisgarh
In Chhattisgarh, an agreement to sell a property—executed before the full sale deed—is legally recognized and subject to stamp duty. The applicable rate depends on whether possession of the property is handed over as part of the agreement.
If no possession is given, a nominal stamp duty of ₹20 is applicable.
If possession is transferred at the time of the agreement, stamp duty is charged at 1% of the total sale consideration or the amount advanced, whichever is higher.
